A 28-year-old Colombian man named Joan Sebastian Guerrero was shot and killed by ICE agents in Biddeford, Maine on Monday, 13 July.
ICE claimed the incident took place after they tried to stop a vehicle from driving away from the target address. However, when the driver tried to pull away, an officer discharged their weapon, ‘fearing for public safety’.
The last part of that statement is crucial: the official ICE communication about the incident, as quoted by the BBC, does not seem to be claiming self-defence on part of the officer; rather, defence of the public. The 1985 Supreme Court decision Tennessee v Garner ruled that an officer can only use deadly force against a fleeing suspect if they pose an imminent threat of death or great bodily harm to either the officer or the public at large.
The office of Senator Angus King, an independent Senator who caucuses with the Democrats from Maine, has released a statement about the recent Maine ICE shooting as well. They write that Senator King had spoken to Department of Homeland Security Secretary Markwayne Mullin, who told him that the deceased Guerrero was not the initial target of the ICE operation.
The Maine Immigrants’ Coalition claims that Guerrero had proper authorization to work in the United States. No news outlet, only some users on X, describes the individual as an illegal alien.
Similarities Between the Minnesota ICE Shooting and the Maine ICE Shooting
The parallels between the recent shooting of Joan Sebastian Guerrero in Maine and the shooting of Renée Good in Minnesota back in January are evident—however, there are some key differences as well.
Good was an anti-ICE protester and American citizen who was actively trying to obstruct ICE operations in Minneapolis, Minnesota. There is no such information coming out about Guerrero yet. As things stand now, it seems that he was most likely an acquaintance of an illegal alien targeted by ICE who got caught up in the operation.
Both Good and Guerrero were shot by ICE agents while driving a vehicle at their direction. In Good’s case, she was repeatedly told to get out of the vehicle by law enforcement, but she instead chose to drive away. The officer who ended up shooting her was standing in front of the hood of the car, and was briefly touched by the vehicle as he was attempting to get out of the way.
We have yet to see any video footage of the events leading up to the shooting of Guerrero. One eyewitness has stated that he was ignoring the officers’ commands to stop and instead accelerated towards them, according to the reporting by the Daily Mail.
Update on the Renée Good Case
Amidst the news coming out of Maine, we also have developments about the shooting of Renée Good in Minnesota.
Federal investigators have agreed to share the evidence requested by state prosecutors in both the case of Good and Alex Pretti. Pretti was another individual shot by ICE agents during a protest in Minnesota in January 2026.
