Charlie Kirk Assassin Case Update: Judge Allows Seeking Death Penalty

Judge Tony Graf rejected a motion from the alleged killer of Charlie Krik and his defence team, who had sought to have the death penalty removed from consideration. The defence argued that the prosecution faced a conflict of interest, since one of the prosecutors’ daughters was present at the scene of the assassination.

Conservative activist and Turning Point USA co-founder Charlie Kirk was killed on 10 September 2025. He was speaking at a public event at the Utah Valley University campus in Orem, Utah, when an assassin hit him in the neck with a rifle bullet. Kirk died at just 31 years old.

Since then, some people on the right, spearheaded by influencer Candace Owens, questioned whether or not Tyler Robinson, the prime suspect charged with Kirk’s murder, was the actual perpetrator. However, his prosecution is already ongoing, and actual evidence seems to be strongly pointing to his guilt.

He also just had two major rulings go against him by Utah District Judge Tony Graf in charge of his case.

One, the defence’s request to remove the entire Utah County Prosecutors’ Office from the case was not granted. Robinson’s counsel argued that since one of the prosecutors’ daughters was present at the Utah Valley University event where the victim was shot, this creates either a conflict of interest or an ‘objective appearance of impropriety’. However, the judge ruled against the motion, arguing that the prosecution routinely engages with people directly affected by the crime, such as victims, family members of the victims, or witnesses.

Supporters of the late Charlie Kirk were even more relieved to hear that Judge Graf also allowed the state to further pursue the death penalty for the defendant. In the same motion, the defence also argued that the presence of one of the prosecutors’ daughters at the scene of the crime could lead to the prosecution being biased towards the harshest sentence. However, with the same decision, the judge shut down that argument as well.

‘The judge did admonish the prosecution office and said that they should have screened off that one prosecutor from any death penalty decisions and said that the failure to do so was not fatal and the case could proceed without disqualification,’ President of West Coast Trial Lawyers Neama Rahmani has said about the most recent development on the Charlie Kirk assasination, as quoted by Bakersfieldnow.com.

As for the evidence against Tyler Robinson: the accused killer’s movement was tracked by home surveillance and traffic cameras as he was fleeing the scene, until a clear enough picture was released to the public by the FBI, asking for identification. This ultimately led them to Robinson, a resident of Washington, Utah.

The investigation found text messages in which he discussed his planned assassination of Charlie Kirk with his transgender lover.
